BTC Now Inc. (“BTC Now,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you visit btcnow.com, use the BTC Now web and mobile application, or otherwise interact with our services (collectively, the “Services”). BTC Now sells Bitcoin to qualified customers on fixed installment terms; we are not a bank, broker-dealer, or money transmitter.
If you enter into a Bitcoin Purchase Agreement with us, the privacy notice incorporated into that agreement (its Privacy & Data Notice) also applies to information handled under that agreement. Where that notice and this Policy address the same topic, this Policy provides the broader public description and the agreement notice governs the specifics of your account.

1. Information we collect
We collect the following categories of personal information, depending on how you interact with the Services:

2. Sensitive personal information
Some information we collect is treated as “sensitive” under applicable law, including your Social Security number or ITIN, government-issued identifiers, and financial account information together with any access credentials. We use sensitive personal information only to provide and administer the Services you request, verify your identity, prevent fraud, evaluate eligibility, and comply with law — not to infer characteristics about you and not for advertising.
3. Cookies and tracking technologies
We and our partners use cookies, pixels, SDKs, and similar technologies to operate the Services, remember your preferences, measure performance, and deliver and measure advertising. These include:
- Strictly necessary technologies that make the site work (e.g., security, session management).
- Analytics technologies that help us understand how the Services are used (e.g., Google Analytics).
- Advertising and retargeting technologies operated with partners such as advertising networks and social media platforms (e.g., Google Ads, Meta) to show you relevant ads and measure their effectiveness.
4. How we use information
- Provide, operate, and improve the Services and your account;
- Verify your identity, evaluate eligibility, and generate and administer Bitcoin Purchase Agreements;
- Process payments and manage AutoPay, and furnish payment history to consumer reporting agencies;
- Detect, prevent, and investigate fraud, security incidents, and prohibited activity;
- Communicate with you about your account, including service and transactional messages by email and (with your consent) SMS;
- Conduct analytics and, where permitted, advertising and marketing of our own Services;
- Comply with legal, regulatory, tax, and recordkeeping obligations (including BSA/AML, OFAC, and FCRA requirements).
5. How we share information
We share personal information only as described below. We do not sell or share your financial account information, Social Security number, credit data, or other non-public personal information for marketing or advertising purposes.
- Service providers that perform functions on our behalf, including: our qualified custodian (Fireblocks Trust Company), bank-data aggregation (Plaid), our payment processor, consumer reporting agencies and credit-data providers, identity-verification and sanctions-screening vendors, cloud hosting, customer support, and communications providers. These providers are contractually limited to using the information for the services they provide to us.
- Advertising and analytics partners, limited to online identifiers and browsing activity collected through our site, as described in Section 3.
- Legal and safety: to comply with law, respond to lawful requests and legal process, enforce our agreements, and protect the rights, property, and safety of BTC Now, our customers, and others.
- Business transfers: in connection with a merger, acquisition, financing, or sale of assets, subject to this Policy.
6. Financial privacy notice (GLBA)
As a financial-services provider, we handle non-public personal information (“NPI”) about you in accordance with the federal Gramm-Leach-Bliley Act (GLBA) and its implementing regulations. We collect NPI to provide the Services you request and disclose it only to the extent permitted by law — for example, to our service providers to administer your account, to consumer reporting agencies, and as required to comply with legal process. We do not disclose your NPI to nonaffiliated third parties for those parties’ own marketing purposes. We maintain physical, electronic, and procedural safeguards designed to protect your NPI.
7. Your privacy choices and rights
Depending on your state of residence, you may have some or all of the following rights regarding personal information we hold about you:
- Know / access the categories and specific pieces of personal information we have collected, and how we use and disclose it;
- Delete personal information we have collected, subject to legal exceptions;
- Correct inaccurate personal information;
- Opt out of the “sale” or “sharing” of personal information for cross-context behavioral advertising;
- Limit the use and disclosure of sensitive personal information;
- Non-discrimination for exercising your rights; and
- Appeal a decision on your request, where your state provides an appeal right.
How to exercise your rights. Submit a request by emailing privacy@btcnow.com or by using the “Your Privacy Choices” link on our website. To opt out of advertising-related sharing, use that link, set your browser’s Global Privacy Control signal, or adjust cookie preferences. We will verify your request using information associated with your account and may ask for additional information to confirm your identity. You may use an authorized agent to submit a request on your behalf where permitted by law.
Timing. We will acknowledge requests within the time required by your state’s law (for California, within 10 business days) and respond substantively within 45 calendar days, extendable by an additional 45 days where permitted, with notice.
Financial information subject to the GLBA and information governed by the federal Fair Credit Reporting Act may be exempt from certain state-law privacy rights; where an exemption applies, we will explain it in our response.
8. Credit reporting (FCRA)
With your authorization, we obtain consumer reports to evaluate eligibility, and we furnish information about your account — including payment history — to one or more national consumer reporting agencies. Your rights under the federal Fair Credit Reporting Act, including how to dispute information we furnish, are described in your Bitcoin Purchase Agreement and its Credit Reporting & Dispute Notice. 9. Data retention
We retain personal information for as long as needed to provide the Services and for legitimate business and legal purposes, including compliance with financial recordkeeping, tax, BSA/AML, and credit-reporting obligations, and to resolve disputes and enforce our agreements. Retention periods vary by data type and applicable law; when information is no longer needed, we delete or de-identify it.
10. Data security
We maintain administrative, technical, and physical safeguards designed to protect personal information, including encryption in transit and at rest, access controls, and monitoring. Bitcoin held under a Bitcoin Purchase Agreement is secured by an independent, NYDFS-regulated qualified custodian using multi-party-computation key management. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11. SMS messaging
If you opt in to receive text messages from us, our handling of your mobile information is described in our SMS Privacy Policy and SMS Terms & Conditions. No mobile information is shared with third parties or affiliates for marketing or promotional purposes; text-messaging originator opt-in data and consent are not shared with any third parties.
12. Children’s privacy
The Services are intended only for adults age 18 and older. We do not knowingly collect personal information from anyone under 18. If we learn we have collected such information, we will delete it.
13. Third-party links
The Services may link to third-party websites and services that we do not control. This Policy does not apply to those third parties, and we encourage you to review their privacy practices.
14. Changes to this Policy
We may update this Policy from time to time. We will post the revised Policy with a new “Last updated” date and, where required, provide additional notice. Your continued use of the Services after the effective date constitutes acceptance of the updated Policy.
